【十二】【如何懲罰酒後駕車?】

How the punishments for drunk driving?
Indeed , drunk driving has drawn into the National level of the criminal law , and penalties for drunk driving not vary by places.
In particular , the punishments must get worse with every subsequent offense , such as increase longer jail time , larger fines , and permanent cancel of license.
For instance :
(1) , Permanent cancel of license ;
(2) , Fines—which should exceed $3,000 ; 
(3) , Forcing use of an interlock device , and you will be able to allow driving again. 
(4) , increase longer jail time ;
As that said , what we can face for a cope with situation.
If drivers are an adult , or they have been arrested for drunk driving , and that said law-enforcement official determined that drivers' blood alcohol content exceed statutory standards , or higher when drivers were driving a motor vehicle.
Punishments for first drunk driving 
For a first drunk driving offense , temporarily its license suspended , in particular , there is fines forced and will be jail time , or gives a community service.
If treatments will not be completed before the drivers license can be reinstated , or Government would be able to require that drunk drivers attend alcoholic treatment program , 
The program must be completed before your drivers license can be reinstated. 
In addition to forcing use of an interlock device that it ensures that drunk drivers , who's blood alcohol content exceed statutory standards , and car will not start.
Penalties for seriousdrunk driving offenses
Penalties for serious drunk driving offenses must be just as harshly , or under the specific situations , car may also be impounded , or receive mandatory jail time as well , especially , the habitual violator.
The same vary in the mandatory jail time given for drunk drivers.
Further , we can think that kick out of their civil rights , such as the right to vote.
If drunk driverscause an accident while driving drunk or injure people , that we can consider the drunk driver could even be charged with manslaughter or murder.

如何懲罰酒後駕車?
其實,酒後駕車應該納入國家刑法行為,酒駕的懲罰,不能因地而異;
特別是每次的犯規行為,必須加重嚴厲的懲罰;
或如增加更長的監禁時間,更多的罰款,與永久取消駕駛執照;
舉例來說:
（1）,永久取消駕駛執照;
（2）,罰款應該要超過新台幣十萬元;
(3) , 強制使用相互鎖定裝置,才能夠被允許再次駕駛;
(4) , 增加更長的監禁時間;
是以也就是說,我們能夠面對的狀況處理:
如果,駕駛人是成年人,或因為酒駕而被逮捕?
那就是說執法人員在駕駛人駕駛汽車時,確定其血液酒精含量超過法定標準,或是更高!
酒駕的初次懲罰
對於初次酒駕違規行為,暫時扣押駕駛執照;
特別是,強制性罰款與監禁,或是給於勞動服務!
或是政府能夠要求酒駕者參與戒酒治療計畫;
如果沒有完成治療,不可以恢復駕照!
另外是,強制裝配相互鎖定裝置;
這是確保酒駕者在沒有超過其血液酒精含量超過法定標準;
那汽車將不會被發動!
嚴重的酒駕懲罰
針對嚴重的酒駕懲罰必須嚴厲地執行;
或是在特定狀況下,扣押車輛,或是強制入監獄;
尤其是習慣性違法者!
針對嚴重的酒駕的監獄時間不能是同款;
此外,可以考慮拿掉公民權利,如投票權;
如果酒駕者發生意外,或是在意外中傷害民眾;
或可以考慮被指控誤殺或是謀殺!
